These Terms of Service ("Terms") govern your use of Spanish Nacho ("the Service"), an AI-powered Spanish tutoring service. By using the Service, you agree to these Terms.

1. Service Description

Spanish Nacho is a Spanish language tutoring service that combines AI-powered practice with human tutor supervision. The Service provides conversational practice, structured lessons, voice exercises, and progress tracking. A human tutor oversees students' learning progress and is available for direct support via the /humantutor command for language questions, feedback, technical issues, or any other enquiry.

2. Eligibility

You must be at least 16 years old to use Spanish Nacho. By using the Service, you represent and warrant that you are at least 16 years of age. If you are under 16, you may not use the Service.

3. Free Trial

  • New users receive a 14-day free trial with full access to all features
  • No credit card is required to start the trial
  • The trial does not automatically convert to a paid subscription
  • When the trial expires, you will need to use the /upgrade command to subscribe and continue using the Service

4. Paid Subscription

  • A paid subscription is activated only when you explicitly choose to pay via the /upgrade command
  • Payments are processed securely by Stripe
  • You can view your subscription status at any time with the /subscription command

5. Cancellation

  • You can cancel your subscription at any time through the Stripe Customer Portal, accessible via the /subscription command
  • Upon cancellation, you will retain access until the end of your current billing period
  • No refunds are provided for partial billing periods

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to abuse, spam, or overload the Service with automated requests
  • Share or redistribute lesson content, AI-generated material, or other Service outputs for commercial purposes
  • Attempt to reverse-engineer, extract, or copy the AI models or training data
  • Harass, abuse, or send harmful content through the bot
  • Create multiple accounts to circumvent trial limitations

We reserve the right to suspend or terminate accounts that violate these terms.

7. Service Limitations

  • Spanish Nacho combines AI-powered practice with human tutor supervision. While the AI provides valuable daily practice and instant feedback, and a human tutor oversees your progress, it should not be considered a substitute for formal language certification programs
  • AI-generated content may occasionally contain errors. The Service strives for accuracy but cannot guarantee perfection in all responses
  • The Service depends on third-party platforms (Telegram, AI providers, payment processors) and may experience downtime or interruptions beyond our control
  • We do not guarantee specific learning outcomes or fluency levels

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Key points:

  • Conversations are automatically deleted after 30 days
  • Voice messages are processed in real time and never stored
  • You can delete all your data at any time using /deletemydata

9. Intellectual Property

  • The Service, its design, branding, and underlying technology are the property of Spanish Nacho
  • Lesson content, exercises, and AI-generated materials are provided for your personal learning use only
  • You retain ownership of any original content you submit (messages, voice recordings)

10. Limitation of Liability

To the maximum extent permitted by applicable law, Spanish Nacho shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service. Our total liability shall not exceed the amount you have paid for the Service in the 12 months preceding the claim.

11. Changes to These Terms

We may update these Terms from time to time. Significant changes will be communicated through the bot. Continued use of the Service after changes constitutes acceptance of the updated Terms.
